Ripple’s Chief Legal Officer Stuart Alderoty expressed disappointment following the US Securities and Exchange Commission’s (SEC) decision to appeal the latest ruling in its ongoing case against Ripple Labs.

Ripple Official Stuart Alderoty Hints at Possibility of Company Cross-Appealing in XRP Case

The SEC filed the appeal on October 2, challenging a previous decision that partially sided with Ripple in the dispute over XRP’s classification as a security.

Alderoty called the SEC’s move a “disappointing but not surprising” move, arguing that it prolonged what he called a “total embarrassment” for the regulator. He noted that the court had previously rejected the SEC’s allegations that Ripple had acted recklessly and noted that there was no allegation of fraud, victimization or loss in the case.

Signaling that Ripple is considering filing a cross-appeal, Alderoty said, “Instead of faithfully enforcing the law, this agency continues to engage in litigation against the industry under this President.” He argued that the SEC’s lawsuit was “unreasonable and misguided from the beginning” and expressed confidence in Ripple’s ability to once again argue its case in the appeals court.

Alderoty also hinted at potential internal changes within the SEC, pointing out that just an hour before the SEC filed its appeal, the agency announced the resignation of Enforcement Director Gurbir Grewal. Alderoty suggested that this resignation may not be a coincidence and raises questions about how the SEC is handling the case internally.
